PRODUCT AND SERVICE DESCRIPTION
Afram Market tries to be as accurate as possible. However, we do not warrant that product or service description or other content of this site is accurate, complete, reliable, current, or error-free. If a product or service offered does not meet your description, your sole remedy is to return it in unused condition.
TYPOGRAPHICAL ERRORS AS TO PRICE
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Afram Market shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your debit card charged.
ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.
Afram Market reserves the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.
Certain orders must obtain pre-approval with an acceptable method of payment. We may require additional verifications or information before accepting order.
Bundled items are included while supplies last. Items of similar value may be substituted.

PAYMENT
Afram Market will not be held liable in respect of any loss or damage arising directly or indirectly to you due to:

CANCELLATION OF ORDERS/REFUND
Afram Market has the right to cancel any order without any explanation for doing so in a situation where we are unable to meet the requirement of the order placed or order so placed/ cancelled does not comply with our policy or for any reason. However, we shall ensure user is communicated on such cancellation within appropriate time and any applicable refund will be made in reasonable time.
USE OF VOUCHER CODES
Voucher card can be used for placement of orders or in exchange for advance payments but should not be substituted for cash.
We reserve the right to cancel or withdraw our voucher codes at any time.
However, this does not apply to vouchers issued in accordance with our refunds policy and vouchers issued in exchange for advance payments.
RETURN POLICY AND LIMITED GUARANTEE
Some products you buy from Afram Market is backed first by the product manufacturer's or supplier’s warranty guarantee may also apply. We may give guarantee provision for either exchange or refund of qualifying merchandise. To determine if the product you wish to purchase qualifies for limited guarantee or if other coverage applies please review the coverage terms in the item listing on our website, consumables and fresh food and some other categories of products may not qualify.
All returns require a Return Authorization number to be issued prior to being returned. Returned products must be in new condition, include original outer packaging, packing materials and other accessories must remain intact.
We reserve the right to refuse for return or charge a restocking fee for damaged, incomplete or otherwise non-conforming returns. Returns will not be accepted without a Return Authorization number issued by us when the product manufactures or distributors return policies supersede ours.

LIMITATION OF LIABILITY
In no event shall Afram Market and any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits.
PROCESSING TIME.
Your order is thoroughly reviewed to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the necessary review, it is sent to our warehouse for shipment.
We do not charge your debit card until your order is shipped; however, we do attempt to get an authorization on your card for the amount of your order at the time your order is placed. This authorization is not a charge but still may utilize a portion of your credit limit or available funds making those funds or portion of your credit limit unavailable for other use. In the unlikely event that your order is delayed or canceled the authorization will expire and your credit limit or available funds will again become available for use. The amount of time it takes for an authorization to expire is dependent on the policies of the bank that issued your card and ranges from 1 to 7 business days.

If the item(s) on your order are in-stock, we will ship them as soon as possible from our warehouse or from one of our Distribution Warehouses. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the back-ordered inventory in our warehouse.
TRANSIT TIME-: 3 - 8 Business Days
Note: Saturday & Sunday deliveries are not available.
TOTAL TIME FOR DELIVERY
Total time is based on the amount of time it takes to get payment authorization, order processing, and the transit time from the carrier. This can range from 24 hours to 10 days for in-stock items.
SHIPPING AND HANDLING
Shipping and charges will be applied to all orders placed with us. If your order must be shipped in multiple boxes, or in separate shipments in the event an item is not in stock and must ship at a later date, shipping and handling charges for the entire order will be assessed at the point when the first item is shipped. DEBIT CARD AUTHORIZATIONS
An authorization on a debit card is a hold against your banks debit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.
RISK OF LOSS
For all other shipments, title to products and risk of loss or damage during shipment passes from us to Customer upon receipt by Customer.
Afram Market retains a security interest in the products until payment in full is received. Customer will be responsible for all shipping and related charges.
DELIVERY
This Site is only for delivery of products to customers within Nigeria. We shall ensure to deliver goods within the estimated time duration set out on our Site; however, there may be room for delays occasionally inevitable due to unforeseen factors. We are not to be held liable for any delay or failure to deliver the products within the estimated timescales where they did not occur due to our fault or negligence.
You agree not to hold us liable for any delay or failure to deliver products or otherwise perform any obligation as specified in these Terms and Conditions of Sale if the same is wholly or partly caused whether directly or indirectly by circumstances beyond our reasonable control.
ACCESSIBILITY OF WEBSITE
We shall make the website accessible at all times; however, we make no representation of that nature and reserves the right to terminate the website at any time and without notice.

The Parties agree that there shall attach no liability for any inability to carry out any obligations under this Agreement if is attributable to an event of force majeure including but not limited to systems downtime, server failure, civil commotion, strikes or lock outs, war, flood, insurrection and other acts of God PROVIDED however that where an event of force majeure continues for a prescribed period of time.
ARBITRATION
Any disputes arising from these Terms and Conditions of Use will be first referred to a private and confidential binding arbitration to be resolved before a single arbitrator held in Nigeria in English and governed by Nigeria law pursuant to the Arbitration and Conciliation Act Cap A18 Laws of the Federation of Nigeria 2004, as amended, replaced or re-enacted from time to time.
The said arbitrator should be legally trained and should be one who has an on hands experience in the information technology laws or convention applicable in Nigeria and is independent of either party.
TERMINATION
Afram Market’s right to terminate this contract without recourse to you remains absolute.
In event such situation arises, you shall be prohibited from further access to and use of the Site and apply both legal or equitable remedies, also immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part.
Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination or any other consequence occasioned by this.

These Terms and Conditions of Use shall be interpreted and governed by the laws in force in the Federal Republic of Nigeria. Subject to the Arbitration section below, each party hereby agrees to submit to the jurisdiction of the courts of Nigeria and to waive any objections based upon venue.
